Housing (Scotland) Act 2014 changes 05/11/19
Just a reminder that the final parts of the Housing (Scotland) Act 2014 have now come into force
Significant changes have taken place to the rules that govern the following situations:
- adding someone to the tenancy (joint tenant)
- transferring the tenancy to someone else (assigning the tenancy)
- subletting the tenancy
- who can take over the tenancy after the tenant dies (succession)
Members of the household (including children and carers) will be subject to a new 12-month qualifying period in connection with these changes. The qualifying period will only begin once we have received notification in writing that they are living in the tenants household. You may remember that we wrote out to all our tenants in October 2018 to inform them of these changes and where applicable to update their household details before the changes came into force.
The changes have been decided by the Scottish Parliament and are now set down in law. There is no discretion allowed to us or any other social landlord with these changes.
